Zazzle: my designs and copyrights are not yours to give away 11 pages: [1] 2 3 4 5 6 7 ... Last

I am going to try to make this as coherent as possible...

I just made my main store private because I was not finished hiding the designs I want to protect from your recklessness.

Today is Nov. 8 and the old terms are still in effect and you have no right to enable collaboration where other users can hijack my copyrights.

I have not agreed to this, it isn't part of the terms I am bound by to allow my designs to be put in jeopardy this way.

I have already seen how this works and I have already seen a screenshot of my one of my own designs that was opened in collab by another user, had a test user invited to collaborate on it and my name as the original designer is not there.

This is unacceptable and if opt outs are not issued quickly I cannot agree to this and you will force me to leave.

To my fellow designers:
your designs are not safe now... but come Novemeber 22 you will have agreed to give them away to any user who decides to start a collaboration with them...just by logging into your account.

Edit: I forgot that private store does not make private products... It should but it doesn't so now I am going back through and hiding things page by page.

I went into create and collaborate. it seems that I must invite someone to collaborate. if I do not invite them, then they do not have access to my designs. what am I missing here? why are my copyrights at risk?

Because Marcia I can open your design and invite someone to collaborate on it. you don't even have to be there... and you won't know when it happens.

I have tested it and so have a few others.

in fact if I have your email address I can invite you to collab on your own design.

Shelli will setting our stores to private also make the products invisible in the MP? Will turning off customize on the publish page work also against collaboration? If not I am following your lead here. I am so upset. This is so wrong.

I just tested it too, you can collab on other people's designs

this puts your copyright at risk because (in case anyone hasn't seen it)

this is from Section 6
Quote:
EACH COLLABORATOR HEREBY GRANTS TO THE COLLABORATION INITIATOR A NONEXCLUSIVE, PERPETUAL, WORLDWIDE, SUBLICENSABLE AND TRANSFERABLE RIGHT AND LICENSE TO USE, COPY, REPRODUCE, PREPARE DERIVATIVE WORKS OF, MODIFY, PUBLICLY DISPLAY, PERFORM AND DISTRIBUTE ASSETS AS CONTAINED IN THE COLLABORATIVE CONTENT ON THE SITE.

and

Quote:
You retain all ownership rights to your Content submitted to the Site. However, by submitting Content to Zazzle, (i) you grant Zazzle a nonexclusive, worldwide, royalty-free, sublicensable and transferable right and license to use, copy, reproduce, prepare derivative works of, modify, publicly display, perform and distribute your Content in connection with the Site and Zazzle's (and any of its successors') business, including without limitation for promoting and redistributing part or all of the Site (and derivative works we may create) in any media now known or hereafter developed; and (ii) you grant other Users the license rights detailed elsewhere herein (e.g., for Collaborative Content, per Section 6).

it's pretty messed up but the new agreement isn't real until the 22 of nov, so you don't have to actually do anything until then

people can still collab but there isn't anything about giving them copyright in the old agreement afaik

It just gets worse and worse!

I also found out I can set my store to private but I will also have to hide each product.

sugarhai, I really didn't imagine that a collaboration without the rights holder would be available. You are right. Zazzle turns their site into a

CC0 free for all

No content is save that is on zazzles site come November 22nd 2019.

Thank you, sugarhai, for repeating the terms over and over.

It isn't safe right now as you can initiate a collaboration already, no safeguards nothing.

I wonder if this goes for "Officially Licensed Brands" too?
Posted: Friday, November 08, 2019 6:16:52 PM
I hope I didn't repeat it too much

but also I'm not doing anything yet

nothing that bad will happen if we just wait and see

the agreement terminates if we close our store so any copyright given away will terminate too I think
Posted: Friday, November 08, 2019 6:19:53 PM
although I tried, I could not figure out how to access any products other than the ones that z provided, or my own. how can I access other people's products?

Yes. Correct. But I won't wait until the November 20th. Zazzles server might have a hard time to cope with artists closing shop.

I start deleting a week before, if zazzle won't announce an emergency stop to those terms.

The products I am posting now do not allow customization, so those are safe from collaboration and adding elements, etc. All others are not. I just made my other products public again, but may re-hide them rather than worry about them. I will keep my store public for the newest designs.

Anyone care to go check one of my newest ones to make sure they are "untouchable"?

Just pick one from the MP or click any name here in the forum to go to a store.

The only thing is the collaboration is already in effect. The initiator and whoever it happens to be may create something with your art and then walk away with your copyright and sell your artwork without you even knowing. Right now we have not agreed to these ridiculous terms but collaboration is already possible. It's setting us up for copyright infringement battles. The reason for hiding our stores is a compelling one.

I was not able to do a collab on your latest products - so maybe that's a good solution

I'm hoping!

When you open any product to customize it further and you are in the design tool there are the invite button and the collaboration button.

Thank you for checking! I will carry on then setting all products to not allow for customization and hiding everything that is set for it. Hopefully Z will allow us the chance to fix all of those.

So we MUST have opt outs and ability to edit published products. and we need them NOW. but guess what? It's Friday and we are in for another long weekend of no nothing from Zazzle...

ok, I feel like a dumb bunny but I still can't do it. I went to a random product (not mine), clicked customize, added a cat to it from the sidebar. could not collaborate (needed to invite someone) - all I could do was click 'done'. saved design still had the original designer's store name, not mine.

I still do not understand how my designs can be used without my knowledge.

I got curious and found a few products from Disney which could be customized (not just personalized) and you can invite someone to collaborate. I bet they won't be happy about giving away their copyright.

Edit: Added an icon, then found the saved design, went to edit and there's no mention of Disney anymore, clicked done and it now says "designed by you".

Since I already logged in for the chat tool with a new user, I used my alter ego account and had a party with another of my email addresses, one that is not registered at zazzle. So ...

OH YES, anybody can invite anybody form anywhere on any MP product right now right this minute. Under the new terms the collaboration would have been in progress and there wasn't even an element added but I would have already handed over my rights to a total stranger without my knowledge.

NUTS
this is nuts

Oh, yeah, this works world wide by the way. You deal with hundreds ... thousands of jurisdictions. Isn't that nice.

It is possible since it says beta that maybe not all designers can see the full collaboration yet. I don't know.

m(_ _)m

This is what it look like:

I accepted and chatted with myself (that is: both to zazzle are not connected to my account vivendulies and practically strangers):

So now, the collaboration is in progress. This us a collaboration with anonymous as you can see.

Has anyone tried to call Zazzle and talk to someone about this? Susan Clark??
