Zazzle has charged me US taxes an I'm a Spaniard living in Spain

I got this email from them today. I scanned the form and my passport and sent them to Zazzle. If I'm not refunded for the taxes they've made ME pay to the US, being a non US citizen as I am, and it being clearly stated, I'm going to start legal action against Zazzle.

Since the beginning of 2011, you may have noticed that your Zazzle earnings were reduced each month due to tax withholding. As we messaged at the beginning of the year, Zazzle is a United States-based company and is required by the U.S. Internal Revenue Service (tax authority) to withhold U.S. federal income tax at a rate of up to 30% from the earnings of nonresident Zazzle Sellers. (Treaties may exist between the United States and other countries, which permit Zazzle to withhold a lower portion of a Zazzle Seller's earnings, as low as 0% in certain cases).

The total amount of withholding from 2010 will be divided equally among your remaining payments for 2011.* This month, you should also receive an annual United States Internal Revenue Service Form 1042-S. We recommend that you consult a tax advisor in your country of residence to determine your obligation to file a U.S. federal income tax return as well as your ability to receive credit from your own country's taxing authority for these taxes, which have been withheld by Zazzle and paid to the U.S. Internal Revenue Service on your behalf. If you have any further questions, please reply to this email.

It's not Zazzle it's the IRS and whether or not they are required to withold taxes depends on your country's tax treaty with the U.S.

Thanks for that link.
But that this comes from the government doesn't make it legal. It's NOT legal.

What's not legal? If you work for a US based company, you pay either a) US based taxes or b)the tax rate your country has agree that the US can charge you. Doesn't matter where you live, it matters where you worked and in this case you worked in the US.

Zazzle has nothing to do with the US taxes. That's the IRS and you'd have to take it up with them. Bringing legal action against zazzle for something they don't control just makes costs go up making our profit go down.

Had you already paid your taxes to the US, and then zazzle started taking them out, that'd be a different story and you'd contact zazzle with copies of proof of payment of US taxes which they could then put in their files for the IRS.

Taxes are a fact of life here in the US......

Malaysia doesn't appear to have a tax treaty, but if you're in the UK and being taxed there, the UK tax treaty should be applicable (but it's best to confirm that with a tax professional).

I contacted a local international tax attorney and got relevant information from that source. You might end up paying a fee - they might answer over the phone as a courtesy - but either way you will at least have an answer from someone who knows what they are talking about.
