Hi Folks,

A bit 'of days ago, I had a product not accepted for a copyright issue because of a quote by Oscar Wilde, author who I thought he was free from particular forms of copyright.

I created this post to thank Zazzle for the excellent support shown on this occasion and to start a list of links that can help sellers avoid citations covered by copyright.
Any help in improving this list is welcome. Smile

I guess they may be applying the section "never Published, never Registered Works" for quotes, which are verbal occurrences. This section grants copyright for the life of the author + 70 years or 120 years after the creation date.
However, this brings up some interesting questions:
1. What if Oscar printed, or hand wrote, one of his quotes inside a copy of one of his works, such as on a introductory page. That would tend to suggest publication for that quote and thus it would be in the public domain under the pre-1923 scenario mentioned above.
2. A newspaper published one of Oscar's quotes during his lifetime. That would also suggest a publication date prior to 1923 since they would likely have a right to do so under fair use - i.e., as a news story.
Disclaimer: I am not a lawyer - this is purely a quick brainstorming session on this matter.

No need to speculate on what copyright rules might apply. The Oscar Wilde thing has nothing to do with copyright. It has to do with a company who claims trademark in that name. They know better than to claim copyright in Oscar Wilde's works. They just claim they have trademarked the name to identify ... well research CMG Worldwide, Inc. It would be interesting if anyone had the will and dollars to argue the point.

See this happen a lot, they think they have exclusive rights to anything to do with the person when if you read they clearly do not. But they win regardless we lose based on a blatant lie. I am sure people have challenged it, and sure that they lost as they really do not have a leg to stand on. Simple but yet? I have never seen this more abused than here, probably as they cannot get away with it elsewhere.

I have read some of the copyright terms of service on many sites that do POD and they are pretty solid on what they need before pulling a design. And I would bet that after reading these there are not as many threats and little if any followup if there was one.

This flooding of threats concerning tags and descriptions many not legally valid, really hurt us all especially since our products are pulled not put in limbo somewhere.

I do have to say that I had a recent one and whoever viewed it must of known it was bogus as they did not remove the design and asked me to contact the person, he never pursued, it,..LOL
